Terms of Service for MenuGen+

Welcome to MenuGen+. These Terms of Service (“Terms”) govern your use of the MenuGen+ mobile application and any related services (together, the “App”) provided by AppSera Ltd. (“we,” “us,” or “our”). Please read these Terms carefully before accessing or using MenuGen+. By downloading, installing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the App.
By using MenuGen+, you agree to comply with and be legally bound by these Terms and all applicable laws and regulations. You also agree to our Privacy Policy, available within the App and at our website.
You must be at least 13 years old to use the App. By using MenuGen+, you represent and warrant that you meet this age requirement. If you are between 13 and 18, you must have parental or guardian consent.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on any Apple-branded products running a compatible iOS, iPadOS, or macOS version.
Account Creation: Some features may require an account. You are responsible for keeping your account credentials confidential.
User Content: You retain ownership of any text, images, or other content you submit (“User Content”). By submitting User Content, you grant us a worldwide, royalty-free, sublicensable license to use, reproduce, and display that content solely to provide and improve the App.
To generate visual menus, the App requests access to your device camera and photo library. You may revoke these permissions at any time in your device’s Settings. Revoking permission may limit certain features.
You agree not to:
Use the App in any unlawful manner or to solicit others to perform unlawful acts.
Harass, abuse, or harm another person or our employees.
Interfere with or circumvent the security of the App or any related website, network, or service.
Reverse engineer, decompile, or disassemble any part of the App, except to the extent permitted by applicable law.
All trademarks, service marks, trade names, logos, and icons are proprietary to AppSera Ltd. or their respective owners. You may not use any of our trademarks without our prior written permission.
The App may integrate with or link to third-party services (e.g., AI-processing platforms). Your use of those services is governed by the third party’s terms and privacy policies.
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AppSera Ltd. BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR DAMAGES FOR LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP.
You agree to indemnify, defend, and hold harmless AppSera Ltd. and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms or your violation of any law or rights of a third party.
These Terms and any disputes arising out of or relating to them shall be governed by the laws of the Federal Republic of Germany, without regard to its conflict-of-law rules. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Berlin, Germany.
We may modify these Terms at any time. When we do, we will update the “Last updated” date above and notify you within the App. Continued use of MenuGen+ after changes indicates your acceptance of the new Terms.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
